Agreement
These Terms of Service ("Terms") govern your access to and use of abovethehook.com, the related subdomains we operate (the Harbor Observatory, the blog, the magazine), and any orders you place through the shop. By using the site or placing an order you agree to these Terms. If you don't agree, please don't use the site.
Who we are
Above the Hook is a sole-proprietor media brand and small e-commerce shop based in Highlands, New Jersey, USA. Contact: shop@abovethehook.com.
Eligibility
You must be at least 18 years old (or the legal age of majority where you live) to place an order. By ordering you represent that you are.
Orders, pricing, and payment
- All prices are in U.S. dollars and don't include shipping or applicable sales tax, which are calculated at checkout.
- Placing an order is an offer to purchase. We may decline or cancel any order — for example, if an item is out of stock, mispriced, or we suspect fraud.
- Payment is processed by Stripe. You authorize us (through Stripe) to charge your card for the total at checkout.
- Typos happen. If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full.
Shipping and risk of loss
We currently ship to addresses within the United States only. See the Shipping Policy for handling times, rates, and the free-shipping threshold. Risk of loss passes to you when the carrier delivers the package to the address you provided.
Returns and refunds
See the Returns & Refunds Policy for the full details. Custom and personalized items are not returnable except for defects.
Intellectual property
All content on the site — text, photographs, video, illustrations, designs, the wordmark, and the look-and-feel — is owned by Above the Hook or licensed to us, and is protected by U.S. and international copyright, trademark, and other laws. You may view and share this content for personal, non-commercial purposes with attribution. You may not reproduce, sell, or use it commercially, train AI models on it, or scrape the site at scale, without prior written permission.
User conduct
- Don't try to break, probe, or overload the site or its APIs.
- Don't impersonate anyone or submit fraudulent orders.
- Don't infringe anyone's rights — yours, ours, or a third party's.
- Don't use the site to do anything illegal.
Third-party services
Checkout is powered by Stripe; fulfillment is handled by Printful; email is sent through Resend; hosting and CDN are Cloudflare and Netlify. Their terms apply to their portions of the experience.
Disclaimers
The site and the products are provided "as is" and "as available," without warranties of any kind, express or implied, except for those that cannot legally be disclaimed. We don't guarantee the site will be uninterrupted, error-free, or perfectly secure, or that the harbor camera and its data will be available at any given moment.
Limitation of liability
To the fullest extent permitted by law, Above the Hook will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of your use of the site or your purchase. Our aggregate liability for any claim relating to a purchase is limited to the amount you paid for the order in question. Some jurisdictions don't allow these limits, in which case they apply only to the extent permitted.
Indemnity
You agree to indemnify and hold harmless Above the Hook and its founder from any claim arising out of your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.
Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or a purchase will be brought exclusively in the state or federal courts located in Monmouth County, New Jersey, and you consent to that jurisdiction. Nothing here limits your rights as a consumer under mandatory law.
Changes
We may update these Terms occasionally. The effective date at the top will change. Material changes apply going forward. Continuing to use the site after a change means you accept the updated Terms.
